Nick Beechey instructed by Gavin Rose of Wells Burcombe Solicitors, persuaded the Court of Appeal Criminal Division to quash their client’s IPP sentence after being granted leave by the full court on a previous occasion. Neither Nick nor Gavin had been instructed in the lower court.
S had been sentenced to an IPP with a minimum term of 3 years in March 2012, in relation to two offences of trespass with intent to commit a sexual offence. He was not granted parole until 2022. 4 months into his parole he was accused of a serious sexual offence and returned to prison. It was after this that he instructed Wells Burcombe. His appeal was allowed on the grounds that the sentencing judge had erred in principle in failing properly to consider S’ relative young age, the prospect of maturity and insight and the effect that an extended sentence with suitable ancillary orders would have had in protecting the public from the risk of future harm. The Court substituted the IPP with an extended sentence, the effect of which is that S will be released immediately without any licence period in force.
